1. Acceptance of Terms

By accessing or using KeyFoby App ("the App" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

KeyFoby App is a business management application designed specifically for locksmith businesses. The Service includes features such as customer management, inventory tracking, sales and expense management, analytics, and AI-powered business insights.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription and Payment

4.1 Subscription Plans

We offer free and paid subscription plans. Paid plans are billed on a monthly basis. Early access pricing ($25/month) applies for the first 4 months, after which the regular price ($50/month) applies.

4.2 Payment Terms

• Payments are processed through secure third-party providers
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time
• Refunds are provided at our discretion for unused portions
• Price changes will be communicated with 30 days notice

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

5. User Content and Data

You retain ownership of all data and content you upload to the Service. By using the Service, you grant us a license to:

• Store, process, and display your data to provide the Service
• Create backups and ensure data availability
• Use anonymized, aggregated data for analytics and improvement

You are responsible for ensuring you have the right to upload any content and that it complies with applicable laws.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Share your account credentials with others

7. Intellectual Property

The Service, including its design, features, and functionality, is owned by KeyFoby and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from Service unavailability.

9. Data Backup and Loss

While we implement backup and data protection measures, you are responsible for maintaining your own backups of important data. We are not liable for any data loss, corruption, or deletion.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for violation of these Terms or for any other reason. Upon termination, your right to use the Service immediately ceases, and we may delete your account and data.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold harmless KeyFoby, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
